Stradling Partner Greg Cordrey was featured in Law360’s article, “Patent Declaratory Judgment Actions Are Back In Vogue,” which examines the recent rise in declaratory judgment actions in patent disputes amid declining PTAB institution rates and the growing influence of Amazon’s Patent Evaluation Express (APEX) program.

Greg shares that the changing patent landscape is prompting companies to reconsider how they challenge patents and whether to take a more proactive approach through declaratory judgment actions. As he explained, “Whether you're a defendant or a patent owner, I think everybody's thinking about how the landscape has changed,” including whether a matter is better suited for inter partes review, post-grant review, ex parte reexamination, or a declaratory judgment action.

Greg also noted that increased declaratory judgment activity reflects greater confidence among patent owners, observing that there is an “increased flurry of activity from patent owners” who may feel more bullish now that they are less likely to face an IPR proceeding at the outset.
