Dental Practice Software Company Secures Dismissal in Breach of Contract Case

Successfully defended a developer of dental practice management software against a suit by a competitor for alleged breach of the parties’ software license agreement. The plaintiff contended that our client breached the license agreement by marketing and selling its own SaaS product to certain large dental practices. Because the undisputed facts indicated that our client had engaged in prohibited sales, Stradling argued that the contract was anti-competitive and thus unenforceable under California law.  Before the court ruled on Stradling’s motion to dismiss the complaint, the plaintiff agreed to withdraw its claims pursuant to a highly favorable settlement agreement.
