Start-Up Action Sports Company Defends Against Fraud Claims

Currently defending the majority owner and several related entities of a start-up company that designs, manufactures, and markets portable ramps and accessories for action sports in a case in which the plaintiffs allege that our client breached his fiduciary duties by purported self-dealing, and fraudulently induced plaintiffs’ original investments into the company. In September of 2021, the court sustained our demurrer to the original complaint, dismissing several claims with prejudice and dismissing the original fraud claims with leave to amend. In January of 2022, the court sustained our demurrer to the amended complaint and gave limited leave to plaintiffs to amend the fraud claims. The case is pending in Orange County Superior Court.
