Large Tutoring Company Secures Summary Judgment in a Class Action & PAGA Case
Secured summary judgment in a class action and PAGA case involving claims that our client, an online educational marketplace that provides hyper-local tutoring services nationwide to school districts, misclassified as independent contractors over 1,000 tutors providing home schooling assistance and tutoring for students in the LA Unified School District. The amount of money at stake was large, and the fees and costs for defending the case promised to be immense. We convinced opposing counsel to agree to first address the issue of whether plaintiff was correctly classified as an independent contractor. If she was not, then she could not represent anyone in the case and the class action/PAGA complaint would be dismissed. By severing off this issue from the case we expedited the determination, saving our client a lot of legal fees. In a 22-page opinion, the court determined that there was no triable issue of fact and plaintiff was not an employee of our client.
