Drone Manufacturer Secures Summary Judgment in Copyright Infringement Matter

Secured summary judgment on behalf of a commercial drone manufacturer against an industry consultant in the U.S. District Court of Nevada.  Our client was the defendant in the suit, and the plaintiff claimed that our client was displaying its photographs on our website without permission.  

We initially took the plaintiff’s default when it did not respond to our counterclaims in June of 2018.  The court subsequently set aside the default but awarded our client its attorneys’ fees.  After the close of discovery, we filed a motion for summary judgment, alleging that the plaintiff had no evidence to support its copyright claims, was not entitled to statutory damages and could not establish any actual damages.  The plaintiff filed its own summary judgement motion, as well as a late motion to compel.  We also filed a motion to strike previously unproduced evidence that the plaintiff attached to its reply in support of its own summary judgment motion. In April 2020, the court denied the plaintiff’s motion to compel, and several months later, the court granted our client’s motion to strike and motion for summary judgment (and denied the plaintiff’s motion).
