BottlecAPPS Secures Favorable Settlement on the Eve of Trial
Stradling client Critical Telephone Applications d/b/a BottlecAPPS was sued twice in the Central District of California and once in the Northern District of Texas for copyright infringement (approximately 150 images in total) by a serial copyright litigant. The asserted images were plain-white-background “bottle shots” with a very industry-standard look. Stradling litigated all aspects of the case and prepared for two consecutive trials in mid June in the CDCA, but was ultimately able to achieve a global settlement of all three cases days before trial following a mediation by Magistrate Judge Steve Kim of the CDCA for approximately 1/6 of the plaintiff’s latest pre-mediation demand.
